A TIRZ is a geographic zone within a municipality, for which the municipality uses incremental increases in property tax and sales and use tax revenues over a period of years to finance public infrastructure improvements within the TIRZ. A TIRZ is not an independent political subdivision; it is an arm of the municipality that creates it.
Our representation includes creating TIRZs, drafting and amending project and financing plans, annexing territory, negotiating inter-local agreements for the participation of taxing entities, negotiating development and financing agreements and serving as bond counsel.
ABHR attorneys pioneered the practice of creating a Local Government Corporation (referred to typically as Redevelopment Authorities) to administer, manage and issue bonds for a TIRZ. Our attorneys have been involved in significant legislation affecting both TIRZs and Local Government Corporations.
ABHR attorneys have also served as bond counsel to Local Government Corporations as well as other issuers in the issuance of tax-exempt contract revenue bonds, securitizing tax increment revenue streams.
